Clothed nudists buck federal judge



Even fully clothed, nudists cannot picket without a permit at the entrance to the Canaveral National Seashore, a federal magistrate has ruled. ;;In rejecting Constitutional arguments, U.S. Magistrate James Glazebrook also fined six picketers a buck apiece. (Charges against the one who videotaped the protest and police intervention were dropped.) ;;While the protesters from Central Florida Naturists were cited for failing to obtain a permit, they arrived at the federal courthouse in Orlando on Aug. 25 to discover they were to be arraigned on slightly different charges involving the failure to apply for the permit.;;The naturists renew a permit monthly allowing them to circulate leaflets at the park, but park officials maintained a different permit was required for the protest at the entrance.;;Glazebrook ruled the seashore, which includes the section of Playalinda Beach over which nudists have been battling for several years with park officials, sheriff's deputies and politicians, qualified as an enclave, rather than a public facility. Thus, the park rangers had the authority to cite the nudists on June 1 for waving signs and beckoning motorists entering the seashore in Brevard County.;;The nudists' attorney, David Wasserman, called the last-minute charge change "trial by ambush" and promised to appeal the ruling. He dismissed as "absolutely ludicrous" the penalty maximum of $5,000 per conviction and said a similar conviction was reversed on appeal.;;Frank Cervasio, president of Central Florida Naturists, said, "While we cannot agree with this denial of all First Amendment rights on federal lands, we must respect the judicial process even as it denies everything the American Revolution was fought for.";;A key subject of this protest and one held on July 4 outside park administrative headquarters was park Superintendent Wendell Simpson, who has been reassigned to the Natchez Trace Parkway in Mississippi. In a final show of its support for Simpson -- and its disdain for the nudists -- the Titusville City Council has voted unanimously to support Mayor Larry Bartley in proclaiming a Wendell Simpson Day.;;Of course, the nudists will be on hand.;;"I'm sure we'll come up with something," said Cervasio's wife, Marianne, a coordinator of Naturist Human Rights Watch.
